RIDER TERMS AND CONDITIONS
1.1. General Use:
– The app user (rider) must be at least 18 years old or accompanied by a legal guardian.
– Riders are responsible for ensuring accurate personal details, including pickup and drop-off locations. Misrepresentation may result in suspension.
1.2. Booking and Payments:
– Riders agree to pay the fare at the end of the ride. Fares are calculated based on distance, time, and traffic conditions. They include applicable fees like taxes, tolls, and platform service charges.
– Failure to complete payments on time, including bounced transactions or non-payment after cash rides, may lead to penalties or service suspension.
1.3. Ride Cancellation Policy:
– Riders can cancel rides within a specific window before the driver arrives without incurring penalties. Frequent or last-minute cancellations (e.g., after the driver has arrived) may lead to charges.
– Cancellations may result in a charge if the driver has already reached the pickup point, depending on circumstances like distance travelled or time spent waiting.
1.4. Responsibilities and Conduct:
– Riders must behave respectfully with drivers and other passengers. Abusive behaviour, physical altercations, or refusal to follow the driver’s instructions (e.g., wearing seat belts) may result in service suspension.
– The rider is responsible for their own belongings during the trip and should ensure no personal items are left behind.
1.5. Data Privacy:
– Personal information, including ride history and payment details, will be collected and used in accordance with the platform’s privacy policy. Location tracking is used to match riders with drivers and calculate fares.
1.6. Liability and Insurance:
– The platform provides limited insurance coverage for accidents during the ride, but riders must understand that certain liabilities may be theirs (e.g., damage caused by the rider). Riders must also comply with laws regarding seat belt use and vehicle safety.
II DRIVER TERMS AND CONDITIONS
2.1. Eligibility and Registration:
– Drivers must possess a valid driver’s license, vehicle registration, and insurance documents. These must be uploaded and verified through the app before activating driver status.
– Drivers are subject to background checks, police verification, and vehicle safety inspections as part of the onboarding process. They are required to maintain these documents to ensure continuous service provision.
2.2. Vehicle Standards and Maintenance:
– The driver must ensure that the vehicle is always maintained in a safe and roadworthy condition. The platform may conduct random inspections, and failure to maintain standards could result in account suspension.
– The vehicle must be fitted with a GPS device and other tracking tools as provided by the platform. Tampering with these devices is strictly prohibited.
2.3. Service Hours and Fatigue Management:
– Drivers are restricted from working more than 12 consecutive hours and must take mandatory breaks between shifts, as per platform guidelines. Ignoring these regulations could result in deactivation to ensure driver safety and customer satisfaction.
2.4. Payment and Commission Structure:
– The platform will collect fares from riders on behalf of the driver. The platform charges a commission for each completed ride, which will be deducted before remitting payments to the driver’s account on a weekly or bi-weekly basis.
– Drivers must ensure that any cash payments received from riders are accounted for correctly in the app, and any discrepancies must be reported within a specific timeframe.
2.5. Code of Conduct:
– Drivers must follow all traffic regulations and always ensure safe driving. The use of intoxicants while on duty is strictly prohibited. Drivers found violating traffic laws or indulging in unsafe driving will face account suspension or permanent deactivation.
– Drivers are expected to maintain polite, respectful interactions with passengers. Any reports of misconduct, harassment, or verbal abuse will be investigated by the platform and may lead to action, including service termination.
III CAB OWNERS/TRAVEL AGENCIES TERMS AND CONDITIONS
3.1. Vehicle Ownership and Licensing:
– Cab owners must ensure all vehicles listed on the platform have valid registration, insurance, pollution under control (PUC) certificates, and other relevant permits required by local laws. They are responsible for keeping these documents up-to-date and submitting copies to the platform upon request.
– The owner is responsible for ensuring that vehicles meet safety standards, including regular maintenance checks, and comply with the platform’s inspection requirements.
3.2. Driver Management and Accountability:
– Cab owners or travel agencies are responsible for hiring and training drivers, ensuring they are compliant with the platform’s policies and possess the necessary skills for safe and efficient driving.
– If a driver employed by the agency violates platform policies or receives multiple complaints, the cab owner may be held liable and subject to penalties or suspension of services for their fleet.
3.3. Revenue and Payment Distribution:
– Revenue sharing between the platform and cab owners is based on an agreed-upon commission rate, which is deducted from each fare. The net balance is transferred to the cab owner’s account on a weekly basis.
– Disputes over earnings or commissions must be raised within a specific timeframe (e.g., 30 days), after which the platform may not entertain claims.
3.4. Responsibilities for Vehicle Damage and Insurance:
– Cab owners must maintain comprehensive insurance coverage for their vehicles, ensuring that any damages caused during the ride are covered. In the event of an accident or damage to a vehicle, the cab owner is responsible for repairs and may not hold the platform liable beyond specified limits.
3.5. Platform Access and Account Termination:
– The platform reserves the right to suspend or terminate cab owners from listing their vehicles if they fail to meet service standards, maintenance requirements, or violate terms related to driver conduct or payment discrepancies.
